1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the AgentKart platform, including the website at agentkart.com, the AgentKart mobile application, and the AgentKart Agent application (collectively, the "Platform"). By creating an account or using the Platform, you agree to be bound by these Terms.

These Terms constitute a legally binding agreement between you and AgentKart. If you do not agree to these Terms, you must not use the Platform.

2. Eligibility

• You must be at least 18 years of age to use the Platform.
• You must be a resident of India or have a valid Indian phone number or email address for registration.
• If registering as an agent, you must hold valid professional credentials and comply with applicable real estate regulations including RERA (Real Estate Regulatory Authority) where applicable.
• You must provide accurate, current, and complete information during registration.

3. User Accounts

3.1 Account Creation

You can create an account using your email address. We verify your identity through a one-time password (OTP) sent to your email. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Types

• User Account: For individuals seeking to buy, sell, or rent property. User accounts can operate in buyer mode or seller mode.
• Agent Account: For licensed real estate agents and professionals providing consultation services.

3.3 Account Deletion

You may request account deletion at any time through the app Settings or via our Account Deletion page. Upon request:

• A 30-day grace period begins, during which you may reactivate your account by logging back in.
• After 30 days, your personal data is anonymized and associated records (appointments, favorites, chat history) are permanently deleted.
• Financial records are retained for 8 years as required by Indian tax and financial regulations.

4. Our Services

AgentKart provides:

• A marketplace connecting property seekers and sellers with verified real estate agents.
• Appointment booking for real-time video consultations and in-person meetings.
• Property listing and discovery tools for buyers and sellers.
• In-app chat and video calling between users and agents.
• A digital wallet system for managing consultation payments.
• Agent ratings and reviews for transparency and trustworthiness.

AgentKart is a platform facilitator. We are not a real estate agency, broker, or financial advisor. We do not guarantee the outcome of any real estate transaction.

5. Wallet & Payments

5.1 Wallet

• Each user and agent receives a digital wallet upon account creation.
• Wallet funds are denominated in Indian Rupees (INR).
• Wallet top-ups are processed through Razorpay, a licensed payment aggregator regulated by the Reserve Bank of India.
• Minimum top-up amount: ₹1. Maximum single top-up: ₹1,00,000.

5.2 Transaction Limits

• Single transaction limit: ₹10,000
• Daily spending limit: ₹50,000
• Monthly spending limit: ₹5,00,000

5.3 Signup Bonus

• New users may receive a signup bonus as credited to their wallet.
• Signup bonuses must be claimed within 7 days of account creation.
• Bonus credits expire 60 days after claiming and are automatically deducted from the wallet balance upon expiry.
• Bonus credits are non-transferable and non-refundable.

5.4 Refunds

6. Appointments & Consultations

• Appointments are booked through the Platform between users and agents.
• Each appointment has an associated consultation fee, which varies based on the type of consultation and agent.
• Users must have sufficient wallet balance to book an appointment.
• Appointment cancellation and rescheduling are subject to the policies outlined in our Refund & Cancellation Policy.
• Video consultations are facilitated through Agora's real-time communication platform. Call quality depends on your network connection.

7. Agent Obligations

If you register as an agent on the Platform, you agree to:

• Provide accurate professional credentials and undergo identity verification (KYC).
• Maintain valid RERA registration where required by state regulations.
• Provide professional, honest, and timely consultation services.
• Keep your availability calendar up to date.
• Not engage in misleading, fraudulent, or unethical practices.
• Comply with all applicable real estate laws, including RERA guidelines.

AgentKart reserves the right to suspend or terminate agent accounts that violate these obligations or receive consistently negative ratings.

8. Property Listings

• Users in seller mode can list properties on the Platform.
• All property information must be accurate, complete, and not misleading.
• Property listings are subject to admin review and approval. Listings that violate our guidelines may be rejected or removed.
• You must have legal authority to list any property (i.e., you must be the owner or authorized representative).
• AgentKart does not verify property ownership or title. Users and agents should conduct their own due diligence.
• Property media (photos, videos) must not contain inappropriate content and must accurately represent the property.

9. User Conduct

You agree not to:

• Use the Platform for any unlawful purpose.
• Provide false, misleading, or fraudulent information.
• Harass, abuse, or threaten other users or agents.
• Attempt to gain unauthorized access to the Platform or other user accounts.
• Scrape, crawl, or use automated means to access the Platform without permission.
• Interfere with or disrupt the Platform's functionality.
• Circumvent any security measures, rate limits, or access controls.
• Use the Platform to send unsolicited communications or spam.

10. Intellectual Property

All content, features, and functionality of the Platform (including but not limited to text, graphics, logos, icons, images, audio clips, software, and compilations) are the exclusive property of AgentKart and are protected by Indian and international copyright, trademark, and other intellectual property laws.

You retain ownership of content you upload (property photos, profile pictures, etc.) but grant AgentKart a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content on the Platform for the purpose of providing our services.

11. Limitation of Liability

• AgentKart provides the Platform on an "as is" and "as available" basis without warranties of any kind.
• We do not guarantee the availability, accuracy, or reliability of the Platform.
• We are not liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Platform.
• We are not responsible for the actions, advice, or conduct of any agent or user on the Platform.
• Our total liability for any claim shall not exceed the amount you have paid to AgentKart in the 12 months preceding the claim.

12. Termination

• You may terminate your account at any time through the in-app account deletion process or via our Account Deletion page.
• We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or upon legal requirement.
• Upon termination, your right to use the Platform ceases immediately. Data deletion follows the timeline described in our Privacy Policy.

13. Dispute Resolution & Governing Law

• These Terms are governed by and construed in accordance with the laws of India.
• Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through mediation.
• If mediation fails, disputes shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.
• For consumer disputes, you may also approach the appropriate Consumer Disputes Redressal Forum under the Consumer Protection Act, 2019.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes through the Platform or via email. Your continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
