New Delhi: A Delhi court has directed the registration of a First Information Report (FIR) against Parsvnath Developers, citing a significant 17-year delay in the construction of a commercial shop in a Rohini mall. This marks the eighth FIR to be lodged against the company and its directors for allegedly defrauding numerous individuals who had paid for residential and commercial properties.
The order was issued by Additional Sessions Judge Dhirendra Rana of Rohini Court, who was presiding over a revision petition filed by complainant Amrit Pal Singh Malhotra. Malhotra’s petition challenged a magistrate court’s order from last year that had refused to register an FIR against the developers.
According to court documents, the allegations across all FIRs against the accused persons are largely consistent: they received substantial sums from investors under the guise of providing flats or shops but failed to fulfill their construction obligations.
In Malhotra’s specific case, he was allegedly promised occupancy of a shop on the third floor of Parsvnath Mall in Rohini in 2007. The agreement stipulated that construction would be completed within 30 months. After paying Rs 33.5 lakh, which constituted the basic price of the shop, Malhotra claims the developers began avoiding his calls. In March 2019, the developers reportedly issued a letter canceling the agreement and provided a cheque for Rs 33.5 lakh, which subsequently bounced.
The court, in its recent ruling, set aside the trial court’s order dated January 2, 2024, which had concluded that no police investigation was necessary in this matter. The court emphasized that the trial court had failed to consider the “glaring” previous antecedents of the accused. Consequently, the Prashant Vihar police station has been instructed to file an FIR against the accused and submit a compliance report to the trial court within two weeks.
